Just using the characters in your original artwork is ok, it falls under fair use. Using the actual artwork from the show is not.

Selling somepony else's IP is a bit iffy under fair use regardless, though.

Because drawing show-accurate ponies requires serious effort, both in actual drawing ability in addition to learning a specific style to emulate.
Tracing on the other hand, is something an 8 year old can do, and is only an investment of time to produce results.
The guy does add his own elements to the drawings, but when a serious part of the drawings is not your own work, it gets a bit hard to take the person seriously as an artist.
Not to mention the fact that you've been passing it all off as your own work this whole time.

There's also the slightly troubling case of him using show asset's for profit, since I'm pretty sure directly tracing things like he's done is pretty much the same thing as a digital copy as far as the law is concerned.

it is the same as some body draws really acurate ponies, you are ripping off copyrighted material for profit.

Well, yes. That. Because I don't. My style is so obviously not the same as the show's style. Granted, similarities do exist, but I tend to add more detail to things like wings and fuzzier spots on a pony. Also, I don't put the gradient in the eyes.

Again, it all comes down to the style and method of drawing.

I have in the past traced stuff (humaniod forms; I've never been able to get their proportions correct), but that was always more of a wireframe to kind of lay down where the limbs bent, how big arms and legs were, thickness and all that.

I have my own style and stick to it when drawing ponies, although guides are used and completely reasonable.

Honestly, I'm conflicted. On one hand, straight tracing kind of seems a cheap way to create art. On the other, these are really obviously traced, and can't say I mind it much since I can acknowledge that. If I were to buy his stuff, I would buy it because the ponies look just like how they are in the show. The problem is between the artist and Hasbro, and it's about copyrights, in my opinion.
Well, if people actually got themselves into false expectations about how he creates his art and were disappointed, I'm not sure how much fault the artist is at, unless he straight out told people lies about how he creates his pieces. But I doubt that is true, since he was hosting an online stream, showing his progress to people.

Edit: I think I got over my mental conflict while writing this, hah.

Producing high-quality vectors takes time and effort: It's not like tracing with a pencil, you need to have an understanding of the difference between vector art and pixel art, and it's actually at least as time consuming as doing all-original vectors.

It's also worth noting that some people think it's cheap to draw existing characters (i.e. fanart) rather than being original.

Strictly speaking, the law supports this, but copyright legislation is such a mess that most companies don't bother enforcing it unless (a) they're forced to acknowledge something's existence or (b) somepony's making a lot of money off it.

I think it was very obvious. Kind of suspect that Horse News is just paraspriting here, but it might be that enough people will take it seriously that Drawponies will actually be C&Ded, which sucks! Some of his stuff was funny. Maybe he can continue with a different art style...

I guess vector is best if you create modifiable bits and snippets so you can create different things in the future. A simple vector is not as much of an art itself perhaps, but more of a tool to create art through their combinations and composition. A clean vector of a character is nice to look at, but it's boring. Use it to make a fancy wallpaper however, and things are different.

It's a bit deeper.
You basically use the linework.

Like the infamous cartoonist Andrew Dobson had some trouble by including somebody else's art in their own work. He basically traced over a photo of the Big Ben which wasn't good legally.

But I admit it. I am ignorant in legal matters.
I still don't like tracing things and saying it's your own art. It feels cheap.

Hey, I had the tragedy of the commons come up in one of my college classes. It's about how multiple parties who share a common land will eventually end up depleting it to their mutual dissatisfaction.

Enjoying stealing a free lunch "because you didn't get caught" is a tad off base because, in the tragedy of the commons, you have permission to use the land, it's not considered stealing because you are developing that land with other parties. The problem is specifically that there's no rule stopping those parties from overdeveloping that land. There's definitely a rule against you stealing lunch.
